[1] According to § 16 par. 12 of Act no. 187/2021 Coll. on the Protection of Economic Competition and on Amendments to Certain Acts, as amended, public procurers and procurers may request a consultation from the Antimonopoly Office of the Slovak Republic if they have a reasonable suspicion that a tenderer or an interested party has entered into an agreement restricting competition during the process of awarding a contract in public procurement (if The applicant is covered by the ZVO).
[2] According to § 40 par. 8 of Act 343/2015 Coll. on public procurement and on the amendment and supplementation of certain laws, the tenderer, to whom the reason for exclusion in question applies, is entitled to prove the adoption of sufficient measures to carry out the correction (if it applies to the ZVO Applicant).
